Welcome to Infiatic. These Terms & Conditions govern your access to and use of our website and any services we provide. By using or accessing the Site or Services, you agree to these Terms. If you don’t agree, you must not use the Site or Services.

Scope of Services

Services Offered. Infiatic provides digital marketing services, including but not limited to SEO Intelligence, Performance Marketing, Social Media Strategy, Marketing Automation / CRM Integration, AWS-powered analytics, and Conversion Optimization.

Service Contracts. If you engage Infiatic for any service, that engagement will be subject to a separate agreement or project brief (including timelines, deliverables, fees, etc.). These Terms supplement (and do not replace) any project-level agreement unless otherwise stated.

Modifications or Updates. You acknowledge that the nature of digital marketing work means deliverables may evolve. Any material change must be mutually agreed in writing.

Use of the Site

Permitted Use. You may browse, download, or print Content from the Site for personal, noncommercial use — subject to these Terms.

Prohibited Use. You may not:

  • Modify, reproduce, publicly display, distribute, or otherwise exploit the Site’s Content without our permission;

  • Use the Site or Services for unlawful, fraudulent, or harmful purposes;

  • Interfere with or disrupt the Site or its infrastructure;

  • Use robots or automated tools to access or scrape the Site without permission.

Account / Registration. If any part of the Site requires you to register or create an account, you must provide accurate information and keep it updated. You are responsible for safeguarding your login credentials.

Intellectual Property

Ownership. Unless otherwise agreed in writing, Infiatic (or its licensors) retains all rights, title, and interest in the Site, Services, and all associated intellectual property (e.g. trademarks, copyrights, software, methodologies).

License to Client. Upon full payment and subject to the terms of your project agreement, Infiatic grants you a nonexclusive, nontransferable license to use deliverables (reports, designs, content) for your business purpose only. This license does not include rights to sublicense or resale.

4.3 Third-Party Components. Some deliverables may incorporate third-party software, content, or assets. Use of such components is governed by applicable third-party licenses, which you agree to abide by.

Fees, Payment & Refunds

Fees. You agree to pay all fees as set forth in your project agreement or invoice.

Payment Terms. Unless otherwise agreed, invoices are due within [e.g. 30] days of issuance. Late payments may incur interest or suspension of Services.

Refunds / Cancellation. Unless specified in your project agreement, payments made for services already rendered are nonrefundable. You may cancel future work with reasonable notice; you remain liable for completed work up to cancellation.

Client Responsibilities & Cooperation

You agree to provide Infiatic with timely access to your website, analytics accounts, APIs, branding materials, and any other information or credentials needed for proper execution.

You represent that you own or have the necessary rights to the materials you provide (images, content, trademarks, etc.), and you grant Infiatic permission to use them for your project.

Disclaimers & Limitations of Liability

No Guarantee of Results. Digital marketing involves multiple variables. While Infiatic aims to optimize performance, we do not guarantee specific rankings, traffic volumes, conversions, or outcomes.

No Warranties. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, SERVICES, AND DELIVERABLES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability. In no event shall Infiatic or its directors, employees, agents, or affiliates be liable for any indirect, incidental, special, or consequential damages (loss of profits, business interruption, data loss) arising from or related to the Site or Services, even if advised of possibility of such damages. Our aggregate liability shall in any case be limited to the total fees paid by you for the relevant Service.

Indemnification

You agree to indemnify, defend, and hold harmless Infiatic and its officers, employees, agents, and affiliates from and against any claims, liabilities, losses, costs, or damages (including reasonable legal fees) arising out of:

  • Your misuse of the Site or Services;

  • Your violation of these Terms;

  • Your breach of any representation or warranty (e.g. ownership of content you provide);

  • Your violation of any third-party rights or applicable law in connection with the Services.

Confidentiality

All nonpublic information (strategies, data, documents) disclosed by one party to the other in connection with a project is “Confidential Information.” Both parties agree to maintain confidentiality and not disclose it to third parties, except as required by law or with consent, for a period of [e.g. 2 years] following termination of services.

Term & Termination

 These Terms remain in force as long as you use the Site or engage our Services.

 Either party may terminate a project agreement for material breach by the other if the breach is not cured within [e.g. 30] days after written notice. Termination of a project does not affect accrued rights (fees owed, indemnification, confidentiality, etc.).

 Upon termination, you shall pay for work performed up to the termination date, and we may suspend or disable access to any deliverables or services.

Links & Third-Party Sites

The Site may contain links to third-party websites or resources. We do not control them and are not responsible for their content, policies, or practices. You access them at your own risk. The inclusion of a link does not imply endorsement.

Privacy & Data

Your use of personal data via Infiatic is governed by our Privacy Policy, which is incorporated here by reference. Please review it to understand how we collect, use, and share your information.

Notices

Any legal notices or other communications must be in writing (email or postal) to the addresses provided in your project agreement or on the Site.

Changes to Terms

We may revise these Terms periodically (for legal, operational, or regulatory reasons). When we do, we’ll post the updated version on the Site and update the “Effective Date.” Continued use of the Site or Services after that means you accept the changes.

Miscellaneous

  • Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in force.

  • Waiver: Failure to enforce a provision is not a waiver of future enforcement.

  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent; we may assign to affiliates or successors.

  • Entire Agreement: These Terms, together with any project-level agreements and the Privacy Policy, constitute the full agreement between you and Infiatic regarding the subject matter.
